Joint Program Executive Office for Chemical and Biological Defense UNCLASSIFIED Chemical Biological Defense Acquisition Initiatives Forum (CBDAIF) February 8, 2007 STEPHEN V. REEVES Major General, USA Joint Program Executive Officer for Chemical and Biological Defense (703) 681-9600 070208_CBDAIF_Brief_JPEO Distribution Statement A: Approved for Public Release 1 Joint Program Executive Office for Chemical and Biological Defense Application of the Uniform Code of Military Justice (UCMJ) to Contractors in the Field Section 552 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (Public Law #109-364) contains a provision that is intended to address whether civilians accompanying an armed force in the field can be tried in military tribunals. The provision states: Paragraph (10) of Section 802(a) of Title 10, United States Code (article 2(a) of the Uniform Code of Military Justice), is amended by striking ‘war’ and inserting ‘declared war or a contingency operation’. In the past, the courts have interpreted the term ‘war’ to mean only wars declared by Congress This change applies UMCJ jurisdiction over persons accompanying an armed force in the field both in time of declared war and in a contingency operation. 070208_CBDAIF_Brief_JPEO UNCLASSIFIED 2 Joint Program Executive Office for Chemical and Biological Defense Status of Sales to State and Local Government • Under the Authority of the Office of Federal Procurement Policy (OFPP) Public Law 108-136 (Section 803) DoD and DHS May Support State and Local Government in Obtaining AntiTerrorism Technologies, Supplies and Services • Process: – DoD and DHS Propose Procedures – OFPP Reviews and Drafts Policy – Policy Published for Public Comment – OFPP Considers Public Comments – OFPP Issues Policy and Procedures – Sales May Begin • Status: OSD Policy Reports No Movement from OFPP Will Provide More Information on Why, When, How To Push 070208_CBDAIF_Brief_JPEO UNCLASSIFIED 3 Joint Program Executive Office for Chemical and Biological Defense Speeding Clearances - Reducing Backlog • GAO Recommended: – More Accurate Measurement of Process Time – Use of Information Technology Solutions – Metrics to Monitor Effectiveness of New Procedures • Industry Submissions Hold Lifted July 2006 – – – – DoD Increasing Electronic Submissions (eQIP) Additional DoD Positions Added to Reduce Adjudication Time All Investigations Placed Under OPM OPM Added More Investigators / Improved Coordination with Agencies OPM Backlog Today: Goal – 80% Complete Within 90 Days Current – 60% Complete Within 90 Days Average Process Time 59 Days Guidance and Information for Industy at: http://www.dss.mil/index.htm 070208_CBDAIF_Brief_JPEO UNCLASSIFIED 4 Joint Program Executive Office for Chemical and Biological Defense Biosurety Regulations Update • Status of Army Draft Regulation: Legal Review On-Going – Draft Army Regulation 50-X Biological Surety Coordinated with OSD to Minimize Disparities with DoD Directive • Provided Last Meeting: – DoD Directive 5210.88 Safeguarding Biological Select Agents and Toxins.
